1. For the purpose of this advertising contract (the “contract”), the term “advertiser” designates the advertiser in person and/or the authorized representative of the advertiser and /or the advertising agency with a mandate to contract advertising for the advertiser, and responsible as signatory of the contract.
2. By virtue of this contract, THE PUBLISHER agrees to provide the advertiser with a rate list with respect to the type of service provided.
3. The advertiser agrees to comply with each and every one of the terms and conditions here mentioned.
4. The advertiser must use the minimum period agreed upon for the contractual period.
5. The advertiser must respect the schedule for payment as indicated on the rate sheet and invoice.
6. Failure to respect these terms and conditions on the part of the advertiser can result in THE PUBLISHER initiating any of the following:
7. Claim payment at the regular rate from the advertiser for each service during the contractual period , based on the service rate sheet effective at the time of the agreement and including any amendments or modifications incurred in the meantime;
8. Suspend services or publication of any future advertising and/or services by the advertiser;
9. Demand of the advertiser, without delay, the immediate payment in full of all accounts with interest.
10. Advertisers who terminate a contract before completion will be subject to retroactive billing at the insertion rate corresponding to the actual service and payable upon receipt of invoice.
11. The failure to publish and insertion on the listing, website or webpage does not constitute a valid reason for the advertiser to cancel the contract.
12. In the event that THE PUBLISHER incorrectly reproduces in part or in whole the advertising listing or service in this contract, to the detriment of its advertising value, THE PUBLISHER and the advertiser agree to negotiate a settlement that could include future online listings and services, or the issue of a credit note in favour of the advertiser.
13. THE PUBLISHER reserves the right to insert the its name or the word “Advertisement” above or below any copy.
14. The condition and terms of payment appear on the invoice and are an integral part of the present contract.
15. Each party of the present contract guarantees that they satisfy the conditions necessary to enter into the present contract.
16. Payment is due once webpage or website and online listing is completed and up to a period of 30days after invoice is issued.
17. The contract of services shall not exceed 3 months and can be renewed there after.
